High-Profile Beating in California Hotel Raises Questions about Rights and Options for Survivors of Hotel Assaults

The viral video showing famous rapper and hip-hop mogul Sean “Diddy” Combs beating his then-girlfriend Cassandra “Cassie” Ventura in a California hotel has been part of the news cycle over the past month since its explosive release to the public. According to news reports, news outlet CNN obtained the security footage of Combs violently assaulting Ventura in a drunken rage on March 5, 2016 at the now-closed California hotel the InterContinental Hotel that was located in Century City. For those Ventura residents that have not seen the video yet, it provides evidence to the world of a vicious assault: Combs, who is only wearing a towel and socks in the video, throws Ventura to the ground and kicks her several times, then grabs her purse and bag and kicks her and drags her on the ground.

The reason that the video took until now to surface is that Combs is said to have paid the hotel $50,000 for the horrifying security footage. Despite the terrifying proof of the assault against Ventura, Combs will not be criminally prosecuted, as the statute of limitations under California criminal laws has already run. The Los Angeles County District Attorney’s Office released a statement about the disturbing footage that reads, “We are aware of the video that has been circulating online allegedly depicting Sean Combs assaulting a young woman in Los Angeles. We find the images extremely disturbing and difficult to watch. If the conduct depicted occurred in 2016, unfortunately we would be unable to charge as the conduct would have occurred beyond the timeline where a crime of assault can be prosecuted.”

Prosecuting Hotel Premises Liability Cases in Ventura Under California Civil Laws

The disturbing footage of Combs beating Ventura raises questions about the rights and options of survivors of assaults at hotel properties. Under California premises liability laws, victims of hotel assaults that occurred due to the negligent security of the hotel owner or hotel property owner may bring a case for compensation (if the case is timely brought per the statute of limitations) in California civil court. Under California premises liability laws, victims of hotel assaults in Ventura may be entitled to money compensation for their injuries and losses. Of course, as the instant case demonstrates, due to the statute of limitations under California laws, it is important to speak to an experienced Ventura premises liability lawyer as soon as possible after a serious assault happens at a hotel.
